on the Spot, as the other persons
named in the Act, to whom the
some Powers are committed.
With reference to the seizure, out British Jurisdiction of Initial
Chinese Repenger Ships for
any Supposed infraction of the Provisions of the Act, My Lords are of opinion
that it would not be prudent
out
to call upon Officers of her Majesty's Service, who are not conversant
with
Legal Forms to enforce these
penalties, and to initiate legal proceedings - especially
as
they observe, that the protection provided by the 11th Section for persons discharging such responsible
and difficult duties are
inadequate
to secure them from serious
Consequences;
further
and my Lords are of
opinion that such seizures of
Antisl
Ship's beyond the Dominions of her Majesty, or the Territories of the East India Company by Officers in her Majesty's Navy, may lead to serious difficulties with Foreign States, and that such powers could only
be exercised if at all by Her Majesty...
